1. 研究目的与意义（文献综述）

in an era of profound social transformation, china has been taking pains in perfecting its legal system, judicial system in particular, by persistently studying western legal practices and spreading its own legal philosophy via translation. faced with the inevitable trend of globalization, legal exchange between china and abroad gains speed in china’s legal system construction. in the late qing dynasty, western law has already been translated into chinese and been introduced to china. recently, discussions on legal translation at home and abroad are continuously heating up. the publications on legal terminology, english grammar and legal translation have been presented in succession. research perspectives of legal translation take on new diversity, research contents go into depth and research techniques get scentific optimization.

legal translation is not merely to translate codes or rules literally. it is involved in conflicts and integration brought by the distinctions between chinese and western values of law. therefore, translators usually have great initiative in translation process. however, the subject of law requires absolute accuracy and impartiality. ambiguous translation would lead to inequitable verdict.

most of the researchers conducted on explaining the complexity of legal language, has shown that vocabulary and terminology has justifiably received the most attention, as lexis fulfills the symbolic or representational function of language better than any other linguistic component. consequently it has been supposed that in legal translation, just finding appropriate equivalent for vocabulary and terminology is sufficient.
